If the "spacer" you refer to is the dense foam ring which self-sticks to the top of the air cleaner filter element just underneath the outside metal cover, this particular ring is used to space the metal cover away from the air cleaner element when using a "real" K & N filter element to order to create some clearance for the cover and prevent it from cracking the metal filter top at the central mounting screw point in the air filter element. It WILL increase the amount the A/C cover sticks out from the side of the engine.

Check out the different center mounting screw clearance between the paper Harley-Davidson filter element and a "real" K & N filter element (K & N PN HD-0800) and you will quickly agree.
